Also has a brand new indoor game-room & outdoor activities, outdoor dining, lounging area and fire pit for those breezier nights in the winter. The space PETS: Although we love our furry guests, this property is not suitable for pets. ***The owner is highly allergic*** EARLY CHECK-IN/LATE CHECK-OUT REQUESTS: If you need special accommodations with early check-in/late check-out, we will gladly help UPON AVAILABILITY. Early check-in fee is $75, payment has to be provided upon request. Late check-out requests are not easily attainable as our staff needs to properly sanitize and clean before the next guests arrive. In the event we do not have a reservation following yours, we will gladly accommodate for a $75 fee and move our cleaning crew to a later schedule or help you extend for the day or night at a special rate. All late check out requests need to be submitted before 8:30pm the evening prior to check out. CHECKOUT DUTIES: If you could kindly start a load of pool towels and a load of white towels in the washing machines, put your trash in the trash bins outside and start the dishwasher. Outside: you will find a propane gas grill (propane included) and also a charcoal grill (charcoal, not included) Parking: depending on car size; 2-3 in driveway and 1-2 in front of the house on the street. OUTDOOR AND POOL: • Please be considerate of the neighbors and keep voices and pool activities to be at a reasonable level. Continued and ongoing screaming or excessive noise for an extended time is one way to upset the neighbors. POOL|SPA: Pool: $100/daily fee (to include spa) to 82 degrees. (More heat is an additional fee) Spa only: $35/daily fee to 102 degrees. (On demand only, must be turned off after use) Gas prices are at an all time high entering the new year, and we do not profit on these fees. If you need the pool/spa heated upon your arrival, let me know at least 24hrs in advance. We can have it ready for your arrival at that time. Pool heating time varies depending on outside temperature. Pool fee can not be refunded unless heating issue is due to a problem with equipment. Pool and spa can not be heated at the same time. If one is heating, the other one is not. Please notify us when you are finished with the spa so that we can keep the heat going in the pool. **Most of the year, heating is not needed except for the winter months upon request. City of Desert Hot Springs Ordinance for Short- Term Rentals: Music cell phone only before 8 pm. It cannot be audible at the property line or front of the house. After 8 pm quiet hours. Please ensure zero music outside and human noise to absolute minimum. Occupancy of max 8 overnight and additional 4 people in the daytime. Breaking any of the city rules will result in code enforcement fines payable fully by guest and potential evictions. If the person that booked the reservation cannot attend to their phone in case of an issue, please provide an alternative number, if we have to dispatch emergency contact, there will be $50 during the day and $100 after 10pm charge to the guest. Please do know we do not micromanage and want you and your group/family have an amazing time and give you full privacy but these have to be observed. CHILD TRAVEL ITEMS: Being a small family business, we love hosting and accommodating all of our guests, especially our younger ones! We do provide pack and plays and high chairs complimentary for our little guests with a 24 hour in advance notice. For any other items such as strollers, car seats, children toys or anything along those lines, we have partnered with a local vendor that can be of assistance. SWIMMING POOL WAIVER AND RELEASE OF ALL CLAIMS AND ASSUMPTION OF RISK ("Waiver & Release") In utilizing the swimming pool amenities ("pool"), you Will be expressly assuming the risk, legal liability, waiver, And release of all claims for injuries, damages, loss or Death which you, your family members, guests, invitees And licensees (collectively, "Pool Area Users") might Sustain as a result of utilizing any and all amenities Connected with and associated with the pool. I and the Pool Area Users agree to abide with the rules of The pool ("Pool Rules"). I Understand that landlord, its Officials, directors, agents, employees, volunteers and Representatives (collectively, "landlord") retain the right To restrict access to the pool for the failure of any person to comply with the Pool rules. WARNING! THERE ARE OBVIOUS KNOWN DANGERS INHERENT IS SWIMMING ACTIVITIES. FOR EXAMPLE: PHYSICAL INJURY, AND IN SOME CASES, DEATH. I. INDEMNIFICATION AND RELEASE OF LIABILITY In exchange for the landlord allowing me to voluntarily Utilize the pool, I understand and agree to: ASSUME AND ACCEPT ALL RISKS arising out of, Associated with or related to my and the Pool Area Users' Use of the pool, even though such risks may have been Caused by the negligence of the Landlord; 2. BE SOLELY RESPONSIBLE FOR ANY INJURY, LOSS OR DAMAGE which I and the Pool Area Users may sustain while using the pool, even though such injury, damage, loss or death may have been caused by the negligence of the Landlord; INDEMNIFY AND HOLD HARMLESS Landlord from any And all claims, demands, actions, liability or costs, Including attorneys' fees, which might arise out of my or The Pool Area Users' use of the pool, even though such Claims, demands, actions and costs may have been Caused by the negligence of the Landlord. a) has the effect of releasing, discharging, waiving, and forever relinquishing any and all actions or causes of action that I may have or have had, whether past, present or future, whether known or unknown, and, whether anticipated or unanticipated by me, arising out of my or the Pool Users' use of the pool; b) constitutes a complete release, discharge and waiver of any and all actions or causes of action against Landlord; c) applies to personal injury, property damage, or wrongful death which I and the Pool Area Users may suffer, even if caused by the negligent acts or omissions of others; d) is an affirmative representation that I am assuming full responsibility for any and all risk of death or or personal injury or property damage suffered by me and the Pool Users while utilizing the pool; and e) is binding on me, my spouse, my heirs, my personal representatives, my assigns, my children and any Guardian ad litem for said children. I. ACKNOWLEDGEMENT I acknowledge that by using the pool I have read this Waiver & Release and that I understand the words and language in it. I further understand that this waiver & Release is intended to be broad and inclusive and Governed by the laws of the state of California, and i agree that if any portion is held invalid, the remainder of the Waiver & Release will continue in full legal force and effect. I further agree that the venue for any legal proceedings shall be in the county of Los Angeles, State of California. I have read and fully understand the above important information, the potential dangers incidental to using the pool, the warning of risks, assumption of risk and Waiver & Release of all claims, and I voluntarily choose to use the Pool.
