On-site fees: General Rental Terms and Conditions General Terms and Conditions (GTC) of Noahkis Apartments GbR, Mittelstraße 24, 56133 Fachbach, represented by the managing directors Lena and Nabil Faddoul 1. Scope of Application These General Terms and Conditions apply to all contracts regarding the temporary rental of the vacation apartment by Noahkis Apartments GbR (hereinafter “Landlord”) to guests (hereinafter “Tenant”), as well as to all related services and deliveries. Any deviating terms and conditions of the Tenant shall not be recognized unless the Landlord expressly agrees to their validity in writing. • Conclusion of the Contract A rental agreement is concluded when the Landlord confirms the Tenant’s reservation in writing, electronically, or by telephone. The reservation is binding as soon as the Landlord has sent the booking confirmation. • Payment Unless otherwise agreed, the total amount for the rental must be paid no later than 7 days prior to arrival. For last-minute bookings (less than 7 days before arrival), the total amount is due immediately. • Prices The prices stated in the contract are final and include the applicable sales tax. Additional costs (e.g., for final cleaning or pets) are clearly itemized during the booking process. • Check-in and Check-out The vacation rental is available from 3:00 p.m. on the day of arrival. On the day of departure, the vacation rental must be vacated by 11:00 a.m. at the latest. A later departure requires the landlord’s express consent and may incur additional costs. • Use of the Vacation Rental The vacation rental may only be used by the number of people specified in the booking. Use for other purposes (e.g., commercial use, events) is prohibited unless the landlord has provided express written permission. The tenant agrees to treat the vacation rental with care and to immediately report any damage caused by the tenant or their guests to the landlord. • Pets may only be brought along with the landlord’s prior written consent. An additional fee may be charged for this, which will be shown during the booking process. • Liability The landlord is not liable for the loss of or damage to items brought into the vacation rental by the tenant, unless the damage was caused by gross negligence or willful misconduct on the part of the landlord. The landlord is liable only for damages resulting from the use of the vacation rental if such damages are attributable to willful misconduct or gross negligence. • Data Protection The tenant’s personal data will be used exclusively for the purpose of fulfilling the contractual relationship and will not be disclosed to third parties, unless this is necessary for the fulfillment of the contract or required by law. • Final Provisions German law applies. The place of jurisdiction is, to the extent permitted by law, the registered office of Noahkis Apartments GbR. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. In such a case, the invalid provision shall be replaced by a legally permissible provision that most closely approximates the economic purpose of the invalid provision. • Furthermore, a bed tax of 3% of the booking amount will be levied.
