Ibis #5 Rental Agreement

Ibis #5 “owner” is William Bruno/WJB Properties. Ibis #5 “rental company” is Buena Vida Properties. Ibis #5 is located at Calle Cardinal Unit 5, Tamarindo, Costa Rica.

The following rules are strictly enforced to adhere to the county’s strict rental regulations and to ensure the owner’s rental permit is not revoked and is annually renewed.

When a reservation is confirmed at Ibis #5 (on any platform) the renter acknowledges and agrees to the following terms outlined below.

The owners reserve the right to cancel any renter’s reservation without notice.

Guests shall allow the Homeowner or Property Manager access to the property for purposes of repair or inspection. The Homeowner or Property Manager shall exercise this right in a reasonable manner.

The renter is liable for the actions of their guests.

TERM OF THE LEASE
The lease begins at [Check-in time] on the “Check-in Date” and ends at [Check-out Time] on the “Check-out Date” of the reservation.

EARLY CHECK IN
Early check-ins are subject to availability and may incur a fee due to enhanced cleaning and third-party cleaning schedules.

CHECK OUT
1. Check-Out is at 10:00 AM.
2. It`s very helpful if you start a load of towels. Do not make the beds that were slept in. Do not fold blankets or towels that were used so they can be properly laundered.
3. Gather all dirty dishes and run the dishwasher.
4. Gather all trash and throw in trash bins.
5. Close all windows and lock all doors.

LATE CHECKOUT
We do not allow late check-outs. The cleaning team needs maximum time to prepare each unit due to our high cleaning standards and occupancy levels. The renter will be charged for a late checkout unless a predetermined agreement has been made between the owners and the renter. Guests that have not checked out by 10:30am on their departure date will be charged $100. After 10:30am, the renter will be charged an additional $100 for every 30 minutes they stay at the property until they vacate. This rule is to ensure the cleaning team has adequate time to prepare each unit for the next guest’s stay.

ADDITIONAL GUESTS
The maximum occupancy limit is 4 guests. If unapproved additional guests are discovered at the property during a stay, the renter will be evicted from the property immediately, charged $250 per guest per night, and they will not receive a refund for the remainder of their stay. If the additional guests are not discovered until after the renter leaves, the renter will be charged $250 per guest per night

PARTIES OR EVENTS
Parties and events are strictly prohibited. This is a zero-tolerance policy. If a party or event is discovered at the property during a stay, the renter will be evicted from the property immediately, charged $250 + damages/additional cleaning, and they will not receive a refund for the remainder of their stay. If the party is not discovered until after the renter leaves, the renter will be charged $250 + damages/additional cleaning.

NOISE
Quiet hours are from 9 PM to 9 AM daily. No renter shall make, cause, or permit unreasonable noise to be emitted from the property that is audible upon private premises in excess of the limits set forth. If the renter violates this rule, the group will immediately be evicted and will receive a $250 fine + any other legal fees accumulated from the altercation.

PETS
A small dog may be considered with prior written approval from the host before booking. Pets are not allowed unless approved in advance. Approved dogs will be subject to a pet fee that must be paid prior to check-in. Any unauthorized pets onto the property will result in a $250 violation fee plus any additional costs for pet-related cleaning, damages, odors, stains, excessive hair, or loss of future bookings. Approved dogs must be fully house-trained, remain off furniture and beds unless protected by guest-provided covers, not be left unattended in the home, be kept under control and not disturb the neighbors, and be cleaned up after in the yard and around the property. Failure to follow these rules may result in additional fees or termination of the stay without refund.

SMOKING & VAPING
No indoor smoking or vaping is allowed. Please responsibly dispose of all butts if smoking outdoors. The use of marijuana inside the home is strictly prohibited. If it is discovered that any guest is smoking inside the property during a stay, the renter will be evicted from the property immediately, charged $250 + damages, and they will not receive a refund for the remainder of their stay. If smoking residue is not discovered until after the renter leaves, the renter will be charged $250 + damages.

FIREARMS & FIREWORKS
The discharging of firearms or fireworks on these premises is strictly prohibited. If either of these rules are broken, the renter will be immediately evicted and will receive a $250 fine + any other legal fees accumulated from the altercation.

ILLEGAL ACTIVITIES
Illegal activity and prostitution are strictly prohibited. If illegal activities are discovered while the guest is in the home, local law enforcement will be notified and the guest will be evicted immediately.

FIRES
Due to the dry climate of the valley and high fire danger, fires of any kind, including campfires, are not allowed at the property.

LOST AND FOUND
Upon request and payment, the rental company will mail back items left at the property. Renters will be charged a $20 convenience fee + packaging + shipping.

AMENITIES
While we strive to provide a comfortable and enjoyable stay for all our guests, please be aware that certain amenities may not be available at all times due to various reasons, including but not limited to maintenance, unforeseen circumstances, or events beyond our control. We will make every effort to communicate any known disruptions in advance and resolve issues promptly.

CONSUMABLE AMENITIES
Initial supplies of amenities like toilet paper and paper towels are provided. Guests are responsible for replenishing these items as needed.

INTERNET SERVICE
Wireless internet is provided as a courtesy. Service can sometimes be erratic. We are not responsible for internet issues and no refunds are issued for internet service problems.

GRILL
The grill is an amenity offered. Please alert the property manager of an empty tank so they can have it refilled for the next guest.

RESTRICTED ACCESS AREAS
The locked owner’s closet is off-limits to our guests.

INSURANCE
We encourage all guests to purchase traveler’s insurance.

CANCELLATION POLICY
If the guest cancels their reservation, the cancellation policy that was in effect at the time the reservation was made will apply. Any changes to the property’s cancellation policy after the booking date will not affect existing reservations. Guests acknowledge and agree that refunds, fees, and applicable charges will be determined according to the original booking terms.

DAMAGE DEPOSIT
Up to $500 could be charged to your card on file if damage is reported after check-out. The damage deposit is for security and a charge will only be made if damage is reported within 14 days of the check out date. Charges may be made due to damage to the property or furnishings, dirt or other mess requiring excessive cleaning or any other cost incurred by the Homeowner due to the Guest’s stay.

STRIPE PAYMENTS
All guest reservation payments processed through Stripe that are canceled will be refunded according to the cancellation policy minus processing fees.

The renter hereby agrees to hold the owners and the rental company harmless against any and all claims, damages, or causes of action for damages arising from injury to persons or property, or loss of life sustained in or about the cabin and improvements thereon, or in or on the walkways, porches, decks, patios, stairways or streets in front of or appurtenant thereto by any person or persons whatsoever.
