Überwachungskamera in Küche und Wohnzimmer

Die eigentliche Unterkunft entsprach - von einer fehlenden Wohnzimmercouch abgesehen - der Objektbeschreibung und den durchweg sehr positiven Bewertungen anderer Gäste. Insoweit waren wir sehr zufrieden. Gleichwohl können wir das Ferienhaus im Ergebnis nicht empfehlen. Die Begründung hierfür steht bei den negativen Feststellungen.

Uns hat das Vorhandensein jeweils einer Überwachungskamera im ausschließlich privat von uns genutzten Küchenbereich und im Wohnzimmerbereich entsetzt. Die Kameras verfügten zwar über Abdeckplatten, die mittels eines Scharniers vor die Linse ausgefahren werden konnten. Diese waren allerdings nicht ausgefahren. Auch erfolgte seitens des Inhabers keinerlei Hinweis auf die Kameras. Damit konnten die Überwachungskameras, bis wir sie am Tag nach unserem Einzug beide entdeckt und abgedeckt hatten, genutzt werden. Dies ist ein eklatanter und schwerwiegender Verstoß gegen die Datenschutz-Grundverordnung (DSGVO), die auch in Frankreich gilt. Die Nutzung dieser Kameras wäre in Deutschland strafbar. Solche Geräte haben in Ferienunterkünften nichts zu suchen. Der Inhaber wäre zumindest verpflichtet gewesen, uns über die Anwesenheit von Kameras vor der Buchung zu informieren, unsere Einwilligung einzuholen und den Verwendungszweck zu dokumentieren. Die ganze Sache war also völlig intransparent für uns. Nachdem wir uns beschwert hatten, wurde uns zur Erläuterung mitgeteilt, die Kameras seien nach wiederholten Einbrüchen von der Versicherung gefordert worden. Sie seien zu einem Sicherheitsdienst geschaltet. Booking.com sei das System bekannt und habe es freigegeben. Man habe vergessen, uns zu informieren, weil wir zu früh - vor 18 Uhr - angereist seien. Letzteres stimmt allerdings nicht. Als Ankunftszeit war 17 bis 18 Uhr vereinbart. Wir haben uns vielleicht zehn Minuten vor 17 Uhr telefonisch beim Vermieter angemeldet. Ich möchte sicherstellen, dass andere Gäste nicht dieselben Erfahrungen wie wir machen müssen. Ich kann mir dabei nicht vorstellen, dass Booking.com dieses System freigegeben hat, wie der Inhaber behauptet. Denn nach den Booking.com-Grundsätzen zu Überwachungseinrichtungen für die Partnerunterkünfte müssen diese transparent sein sowie die örtlichen Gesetze einhalten. Eine Überwachung in privat genutzten Bereichen ist danach nicht erlaubt.
